United Communications Group &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp 2008 WL 902644</h3> <p><i>Issue:</i> Whether reversal of denial of anti-SLAPP motion entitled party who secured reversal to his attorney fees.</p> <p><i>Disposition:</i> Affirmed; Costs for Respondent. The court held: Trial Court s denial of Gunther s motion for attorney fees under anti-SLAPP statute was affirmed.</p> <h3>Elisha Sabi v. Sterling (Amicus AAOC) &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp 183 Cal.App.4th 916; 107 Cal.Rptr.3d 805</h3> <p><i>Issue:</i> Mandatory Section 8/source of income discrimination</p> <p><i>Disposition:</i> Affirmed (Certified for Publication). The court held: Section 8 assistance payments to landlord were not included in tenant s income, for purposes of tenant s claim alleging violation of FEHA s prohibition against discrimination based on source of income. Legislative history did not show purpose of amendments to FEHA was to compel landlords to participate in Section 8 program.</p> <p><a href="http://scholar.google.com/scholar_case?case=15231257245888207573&hl=en&as_sdt=2&as_vis=1&oi=scholarr">Click here for more information about the case.</a> </p> <h3>Flanigan v. Gausewitz  (February 22, 2011) &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp 2011 WL 600442</h3> <p><i>Issue:</i> Whether the Flanigans stated a claim against the Gausewitzs (our clients) in this second lawsuit between the neighbors as to an easement between their properties, or whether the Flanigans claims were properly dismissed by the trial court.</p> <p><i>Disposition:</i>The Appellate Court agreed with our clients position that the claim of quite title was barred by res judicata and the prior litigation, and that the claim for trespass should be dismissed.  The matter was reversed so the Flanigans could pursue only a declaratory relief action based only upon a minor issue of parking.  No claims for damages remained after the appeal.</p> <h1>Representative Cases (judgment in client s favor)</h1> </p> <h3>Marinakos v. Chiang, et al. (September 8, 2011)&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp Case No. BC438703, Los Angeles Superior Court</h3> <p>Successfully obtained summary adjudication on behalf of client in wages and hours employment case, alleging Labor Code violations for violation of minimum wage protections, violation of overtime compensation protections, failure to reimburse employee expenses, failure to provide accurate wage statements, and also alleging wrongful termination in violation of public policy.  These claims alleged by Plaintiff were dismissed against client after Motion for Summary Adjudication was granted.</p> <h1>Representative Cases tried to verdict</h1> </p> <h3>Kerr v. Ali</h3> <p>Defended Plaza Deli in wrongful death lawsuit filed by family of young woman who died in a single rollover Porsche accident. Plaintiff argued the defendant driver was in the course and scope of employment at the time of the accident, and that Plaza Deli was therefore responsible for the accident. Received judgment of non-suit for Plaza Deli.</p> <h3>Harmon v. Conestoga Hotel </h3> <p>Defended Conestoga Hotel in lawsuit by guest of hotel. Plaintiff alleged a dangerous condition of the interior staircase and claimed over $350,000 in special damages. Received defense verdict.</p> <h3>Barnes v. Hillman</h3> <p>Defended homeowner in premises liability action involving carpeted stairs. Plaintiff alleged a dangerous condition and claimed over $200,000 in special damages. Received defense verdict. <h3>Tennant v. Purdy, City of Garden Grove</h3> <p>Defended City of Garden Grove and Officer Purdy in lawsuit stemming from a two-vehicle traffic collision. Officer Purdy was responding to a robbery in progress, and entered the intersection on a red light with lights and siren activated. Plaintiff collided with Officer Purdy in the intersection and claimed the officer was at fault.
